The National Energy Services Company (Tarshid) Privacy Policy

  

Introduction 

  • The National Energy Services Company with its registered address at King Abdullah Road, Al Rahmanyyah, Riyadh (the "Company") shall respect the privacy of users' personal data or sensitive personal data shared with the Company based on the Personal Data Protection Law and its Regulations and Data Protection Standards (Data Privacy Laws) applicable in the Kingdom of Saudi Arabia. For the purposes of  the applicable Data Privacy Laws, the Company shall be the  “data controller” of User’s personal data. 

  • This Privacy Policy sets out the basis on which we will process any personal data we collect from Users, or that Users provide to us, regarding their use of our Website www.Tarshid.com.sa ("the Website"), the Company’s secure web applications, the Company's mobile phone application, the Company's pages on social media platforms, and any other technical platforms of the Company (the "Platforms"), and in relation to the services we provide to Users (collectively referred to as "our Services" or “the Services”). 

  • This Privacy Policy shall apply to all users and visitors (referred to below as the "User" or the "Data Subject") who have the right to access or use the Website and Platforms. 

  • This Privacy Policy will allow Users to understand their rights regarding their information, how it is collected, used, and processed. 

  • Our Website and Platforms are not intended for children, and we do not intentionally collect data related to children. 

  • We may amend this Privacy Policy from time to time, and it is the user's responsibility to regularly review the Website for the latest updates to the Privacy Policy. 

  

Collection of Data: User-Provided Data 

The Company may collect personal data directly from the User as part of providing services on the Website. This may include email addresses, mobile phone numbers، first names, last names, resumes,  work field, work sector, or any other personal data that the user provides to the Company through the Website. When collecting personal data from Users, the Company will identify which personal data is mandatory for the purposes of providing the Company’s Services and which personal data is optional. 

 If Users do not provide the personal data which is mandatory for the provision of the Services, the Company will be unable to provide the Services to the Users. 

  

Data Collection: Automatically Collected Data and Cookies 

The Company may automatically collect some personal data sent by the User’s browser whenever they visit the Website, such as data collected through cookies or other tracking technologies. This may include: 

  1. Internet Protocol (IP) address. 

  1. Device details, including, but not limited to, device name, operating system type, unique device identifiers, malfunction data, system activity, device settings, and locally stored information on User devices.

  1. Standard web information such as browser type, language, referral URL, request date and time, and pages accessed on our Website.

Security information, including a list of some installed programs, device information, internet connection details, and available space on the device. Additionally, we may collect and process location information when Users use our Website and Services through various techniques, such as Wi-Fi access points and IP addresses. 

We use cookies and similar technologies to collect information about Users’ browsing activities over time and across different websites after Users use our services. Cookies allow us to identify the number of Users and understand how users navigate our Website. This helps us improve our services and website efficiency.

Data Collection: Other Data Collection Methods 

  • The Company may generally collect User personal data directly or indirectly through third parties (for example through social media platforms). This can be realized through the User's interaction with the Company's Website, other social media platforms, phones, email, or correspondence with the Company. 

  

Data Usage 

The Company may use the User's data collected directly or indirectly (for example through third-parties) to fulfill its duties and responsibilities as an organization, to respond to the User and provide effective Services, and to maintain its commercial relationships and legitimate interests, such as: 

  • Creating a ‘user account’, if necessary, where the User can log in using their username and password and access the various services provided by the Website. 

  • Marketing, to understand user behavior and preferences, create targeted advertising campaigns, improve User Experience, and market research. 

  • Processing the data provided by the User during the account registration process, their resume, the jobs they have applied for, and the messages they have sent and received from this Website or through a third party.

*User personal data will not be subsequently processed in a manner that that is inconsistent with the collection purposes (except where permitted under applicable Data Privacy Laws). 

  

Marketing and Awareness Purposes 

The Company may process User personal data for the purposes of sending marketing or awareness communications. In such instances, the Company will only process User personal data if the User has provided their prior opt-in consent for each of the following: 

  • Receiving marketing communication via email. 

  • News and updates via email through subscription to the Company’s Newsletter. (Please note that certain security and privacy related notifications may be provided to Users even if consent has not been provided.) 

  

Data Sharing 

The Company will not share User personal data with third parties, except: 

  • With service providers: (1) data analysts; (2) security service providers; and (3) web hosting service providers. This is to provide data storage services, disaster recovery, and communication with the User. 

  • When the User agrees to share specific personal data with third parties. 

  • With professional advisors; we may share your data with professional advisors who act as service providers such as auditors, law firms, or accounting firms. 

  • For legal and security reasons, and to protect the Company's Services and operations, and for its legitimate interests or as required by any applicable laws. We may share your data with legislative, executive authorities, or any other relevant organizations: 

  1. To comply with legal obligations. 

  1. If the Company deems it necessary to share User personal data to comply with applicable law or obligations, including cooperation with enforcement agencies and court orders. 

  1. To protect our interests, Users, or third parties, and ensure their safety and security. 

  1. For advocacy and defense. 

  1. To enforce our terms and conditions or other applicable terms of service or other agreements. 

  1. With our affiliated companies, for our legitimate interests. 

  

In addition to the above-mentioned, the Company may disclose User personal data in the following cases: 

  • When personal data is collected from a publicly available source. 

  • Upon request from a public authority, provided that the request is for public interest purposes, security purposes, to enforce another law, or to fulfill judicial requirements under the provisions of the Personal Data Protection Law in the Kingdom of Saudi Arabia. 

  • When disclosure is necessary to protect public health or safety, or to protect the life or health of a specific individual or individuals. 

  • When disclosure is made in a manner that does not lead to the identification of the user's identity or any other individuals. 

  • When disclosure is necessary to achieve legitimate interests of the Company, provided that no sensitive personal data is disclosed and further provided that it does not infringe upon the rights of the User or conflict with their interests. 

  

Data Storage and Processing Location 

Given our presence in the Kingdom of Saudi Arabia, the information we collect from Users will be transferred, stored, and processed within the Kingdom of Saudi Arabia. Where permitted by applicable Data Privacy Laws, the Company may also transfer User personal data to other countries, as determined by the Company, to provide Services to Users. 

 We will take all necessary reasonable steps to ensure the secure handling of User personal data in accordance with this Privacy Policy and applicable Data Privacy Laws. 

  

Data Retention Period  

We will retain User personal data as follows: 

  • Contact information and other registration information for as long as necessary to provide you with our Services. 

  • Technical use information for 5 years. 

  • If Users contact us, we will retain User personal data for 5 years after your contact with us. 

  • Data related to a User’s use of our Website and Services will be retained for 3 years. 

  • We will also retain and use User personal data as necessary to comply with our legal obligations, resolve disputes, enforce provisions, and other terms of service and policies. After that, we may store your information in aggregated and anonymized formats and may use this information indefinitely without further notice. 

  

Security 

While we make every effort to protect User personal data by implementing appropriate technical, organizational and administrative measures and controls to safeguard the personal data Users provide against accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure, transfer or use. The Company cannot guarantee the security of User personal data transmitted through the Website, email, text messages, or other Platforms. The Company shall not be held liable for unauthorized or unintended access beyond its control.

The Company strives to provide high-quality services to all individuals regarding their personal data, ensuring their rights as outlined in the Data Privacy Laws and other applicable laws, including: 

  1. Right to be informed: Data Subject shall have the right to be informed about the collection and use of their personal data, including the reasons and methods of collection, processing purposes, retention period, and with whom the data will be shared. 

  1. Right to Access: Data Subject shall have the right to access their personal data held by the Company, subject to the controls and procedures set forth by the applicable Data Privacy Laws in the KSA. 

  1. Right to Obtain Personal Data: Data Subject shall have the right to request access to their personal data held by the Company in a readable and clear format, in accordance with the Data Privacy Laws. 

  1. Right to Request Correction: Data Subject shall have the right to request the correction, completion, or the up-to-datedness of their personal data held by the Company. 

  1. Right to Request Deletion: Data Subject shall have the right to request the deletion of their personal data held by the Company, in accordance with the applicable laws. 

  1. Right to Withdraw Consent: Data Subjects have the right to withdraw their consent at anytime for any personal data that the Company processes on the basis of their consent (although if Data Subjects withdraw their consent, this does not affect the processing of personal data before the consent is withdrawn). 

  1. Right to ‘Opt-out’: Data subjects have the right to ‘opt out’ of processing for direct marketing and/or advertising 

 Users should be aware that some of these rights may only apply in specific circumstances, and these rights may be restricted if permitted by applicable Data Privacy Laws. 

 Users that wish to withdraw their consent may do so by contacting us at the email address provided at the end of this Privacy Policy. 

 Please note that if a User withdraws his or her consent to the processing of his or her personal data it may become impossible for the Company to provider the Services to the User. 

  

Third-Party Links 

The Website may contain links to other online platforms, additional content, or other applications managed by third parties. The Company does not control such websites or other applications. Thus, the Company shall not be liable for the content of other platforms, their privacy policies or their use of User personal data, including information Users share on third-party social media platforms, which may also be viewed by other website users and/or users of third-party internet platforms without restriction on their use by us or by the third party. Our inclusion of such links does not imply, in itself, any endorsement of the content on these platforms, their owners or operators except as disclosed on the Website. We expressly disclaim any and all liabilities for the actions of third parties, including, but not limited to, actions related to the use and/or disclosure of information by third parties. Any information Users directly provide to these third parties is subject to the privacy policy of the third parties. 

  

Legal Basis for Processing Personal Data Without User Consent: 

As per the applicable Data Privacy Laws in the Kingdom, the Company may process user personal data without consent when processing in the following cases: 

  1. When the processing serves actual interests of a Data Subject, and contacting the Data Subject is impracticable or would be unduly burdensome. 

  1. When the processing is required by another law or is carried out in fulfillment of a previous agreement to which the Data Subject was a party. 

  1. When the processing is necessary to achieve the legitimate interests of the Company, provided that it does not infringe upon the rights of the Data Subject or conflict with their interests, and the personal data does not include sensitive personal data. (Processing for legitimate interest is subject to the applicable provisions as per Data Privacy Laws governing such processing).

If Users have any requests, complaints, or inquiries regarding the processing of their personal data or this Privacy Policy, please contact us at the “Contact Us” and we will respond to requests as soon as possible. 

  

Language 

Except as provided in applicable laws, in case of any conflict between the English version and the Arabic version of this Privacy Policy, the Arabic version shall prevail.
